The petitioners apprehend their arrest in Ara Nawada P.S. Case No. 377/2016, registered for the offences punishable under Section 420 and other sections of the Indian Penal Code. The informant alleged that her brother-in-law Pratap Singh had gone to Patna for coaching for getting job in Railway. Sanjay Singh (petitioner no. 1) and Sudhir Singh (petitioner no. 2) came across her brother-in-law. The petitioners assured him to provide job on payment of Rs. 5,00,000/-. The informant gave Rs. 4,00,000/- to Sanjay Singh in his house situated in Housing Colony Ara, but Sanjay Singh and Sudhir Singh did not provide

Learned counsel for the petitioners submits that the petitioners filed complaint case against Dinanath Sah and Kaushik Chakrawarti. Money was paid in the account of Kaushik Chakrawarti who had assured to provide job. It is submitted that thereafter this case has been filed at the instance of Kaushik Chakrawarti. No date of payment of money is mentioned in the F.I.R.

Considering the facts aforesaid and the fact that there is no chit of paper to show that the petitioners received any money from the informant, the petitioners above-named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Ara in connection with Ara Nawada P.S. Case No. 377/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
