JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-11-2018 The petitioner seeks regular bail in connection with Phulwarisharif P.S. Case No. 437 of 2018, registered for offences punishable under Sections 364, (120(B)/34 of the Indian Penal Code.

Allegation is of kidnapping the son of informant and he is still traceless. It further appears that the motorcycle of the victim has been recovered from the Verandah of the house of the petitioner.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and and F.I.R itself shows that the victim had gone to meet Santoesh Rai with whom the victim boy had a quarrel a month's ago and somebody has kept the motorcycle of the victim at the

Patna High Court Cr.Misc. No.53506 of 2018(3) dt.02-11-2018 2/2 verandah of the house of the petitioner to implicate him in this case. Further he has no criminal antecedent and has been in judicial custody since 04.07.2018 Learned counsel for the State opposed the prayer for bail and submitted that the victim boy is still traceless and motorcycle of the deceased was recovered from the verandah of the petitoiner.

Having heard both sides, considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail.

This application is, accordingly, dismissed.
