Petitioner seeks regular bail in connection with Gopalpur PS Case No. 148 of 2021 registered under Section 30 (a) of the Bihar Prohibition and Excise Amendment Act, 2018. 39.600 liters of country made liquor has allegedly been recovered from the motorcycle which was being driven by the petitioner.

Learned counsel for the petitioner submits that petitioner is not the owner of the motorcycle in question and had borrowed the same from his friend and was not aware about the illicit liquor kept in the bag. He next submits that petitioner is in custody since 18-07-2021 and charge sheet has already been submitted.

No.51586 of 2021(3) dt.05-05-2022 2/2 Regard being had to the submissions made by the parties, taking into consideration the material on record, the fact that petitioner is in custody since 18/07/2021 , charge sheet has already been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidence if released on bail , as such, I am inclined to grant regular bail to the petitioner.

Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 25000 /- ( twenty five thousand ) with two sureties of the like amount each to the satisfaction of learned IInd Additional Sessions Judge -cumSpecial Judge (Excise), Gopalganj in connection with Gopalpur PS Case No. 148 of 2021.
