The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 504, 506, 376, 511, 447/34 of the Indian Penal Code section 3(1) (x) (xi) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
It is alleged that petitioner made an attempt to ravish the informant while the informant went to ease out. It is further alleged that when the informant narrated the story to the family members thereafter all accused persons came, abused the informant by calling caste name and threatened not to lodge case.
It is submitted by learned counsel for the petitioner that even assuming the accusation, no case under section 376 of
Patna High Court Cr.Misc. No.39239 of 2015 (2) dt.05-10-2015 2/2 the Indian Penal Code is made out. It is further submitted that father of the petitioner earlier lodged Sasaram (M) P.S. Case No.12 of 2015 against the victim's side. Moreover, statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with SC/ST Dehri P.S. Case No.2 of 2015, pending before the learned CJM, Rohtas at Sasaram.
With the above observation, this application is, accordingly, disposed off.
