Petitioner seeks bail in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.
Petitioner is husband of the victim of dowry death. Allegation is of demand of dowry and torture for the same. Submission of the learned counsel for the petitioner is that due to quarrel in the family, the victim committed suicide and just to pressurize, false case has been lodged. Earlier the informant had informed the Court that the victim had left the suicide note. Thereafter, this Court asked for report from the FSL regarding genuine writing of the victim on the suicide note, after comparison with her admitted writing. The
Patna High Court Cr.Misc. No.48412 of 2017 (6) dt.08-03-2018 2/2 suicide note is in Hindi and in English script. The informant did not cooperate with the police. Thereafter from the school record Hindi writing of the deceased was taken by the FSL. However, police is yet to get the English writing of the victim and thereafter to submit report. The petitioner is in custody since 27.03.2017. Investigation is already complete and the petitioner is ready to cooperate with the trial.
Learned counsel for the informant opposed the prayer for bail.
Considering the facts and circumstances aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Mirganj Police Station Case No. 76 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
