JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-07-2019 Petitioner seeks bail in anticipation of his arrest in connection with Alamnagar P.S. Case No. 194 of 2018, registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act pending in the court of Chief Judicial Magistrate, Madhepura. Allegation is that accused persons came variously armed and surrounded the husband of the informant. Further allegation is that petitioner caught hold of her husband and other accused fired at him, causing his death.

Submission of learned counsel for the petitioner is that FIR disclosed that he is not the assailant. Heard learned APP also.

In view of above facts and circumstances and also direct involvement of the petitioner, I am not inclined to grant the privilege of anticipatory bail to the petitioner.
