The petitioner has preferred this application for grant of regular bail in a case registered under sections 401, 461, 379, 511 and 427 of the Indian Penal Code and sections 25(1-B)(a), 26 and 35 of the Arms Act.

As per the prosecution case, on seeing the police personnel it is stated that the accused persons who were standing outside the ATM machine made an attempt to escape but five of them were caught. On further inquiry it transpired that while Shubham Kumar and Kundan were inside the ATM using a gas cutter to cut the same the other accused persons were outside.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.52536 of 2021(4) dt.20-04-2022 2/2 that the petitioner has been falsely implicated in the case. He was caught under a misunderstanding. He is a student and does not have any criminal antecedent. He is in custody since 19.4.2021 and charge sheet has been submitted in the case. Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner having remained in custody for 1 year and charge sheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Kankarbagh P.S. Case no. 407 of 2021, G.R. no. 3081 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M-1st Class, Patna.
