The petitioner seeks bail in Sessions Trial No. 67 of 2018/389 of 2018 arising out of Arwal P.S. Case No. 145 of 2018 instituted for the offence under Section(s) 302/34 of Indian Penal Code. Charge sheet has been submitted under Section 304(B) of the Indian Penal Code.

Petitioner is husband of the deceased.

Counsel for the petitioner submits that in the instant case evidence of all the witnesses have been recorded except the informant. The case is pending for evidence of the informant for last several months.

In such circumstances, the trial is at the advance stage and all the witnesses have already been examined except

Therefore, this Court is not inclined to grant bail to the petitioner.

Prayer for bail of the petitioner stands rejected. The trial court is directed to conclude the trial of the petitioner within a period of four months from the date of receipt of this order after examining the informant and other necessary witnesses and send compliance report to this Court. The court below will not give unnecessary adjournment to the prosecution or to the accused in this case.

The S.P. concerned is also directed to produce the witnesses in the case including the informant on date fixed in the case.

The court below will communicate the order of this Court to the Superintendent of Police concerned for production of informant and other witnesses if any for evidence on the date fixed in the case.
