Mr.Rabindra Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 20-05-2022 Heard the parties through video conferencing. Petitioner seeks regular bail in connection with Pasraha PS Case No. 59 / 2021, G.R. No. 1368 / 2021 registered for the offence under Sections 366 / 366 -A of the IPC. As per the first information report the petitioner along with other accused persons abducted the minor daughter of the informant for the purpose of marriage.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case due to village rivalry and he has not committed any offence in the manner alleged. He further submits that statement of the victim girl was recorded under Section 164 of the Cr.P.C. (annexed at Annexure- 2 to the bail application) and from perusal of the

Patna High Court CR. MISC. No.57091 of 2021(2) dt.20-05-2022 2/2 same it would be evident that when victim was scolded by her mother, she left her house and went to the house of her Mausi. Nothing objectionable has been disclosed by the victim against the petitioner in her statement recorded under Section 164 of the Cr.P.C. The petitioner is in custody since 20.06.2021. Learned counsel further submits that similarly situated co-accused / Prakash Singh has been enlarged on bail by this Court in Cr. Misc. No. 51634 of 2021 vide order dated 15/04/2022. Regard being had to the submissions made by the parties, taking into consideration the statement of the victim girl recorded under Section 164 of the Cr.P.C.

and the fact that similarly situated co-accused has been granted bail by this Court, I am inclined to grant regular bail to the petitioner. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 10000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Deepak Kumar, Judicial Magistrate 1st Class, Khagaria in connection with Pasraha PS Case No. 59 / 2021, G.R. No. 1368 / 2021.
