The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 325, 307, 379, 341/34 of the Indian Penal Code. The son of the informant is an eyewitness of the occurrence. However, he alleges that the petitioners bitterly assaulted to Md. Sami with rod, Chaaku etc. Md. Sami has also supported the aforesaid fact. However, the injury report would reveal that single fracture injury was found by the Doctor caused by hard and blunt substance on the person of Md. Sami. The witnesses examined before the Police have stated that in
Patna High Court Cr.Misc. No.54604 of 2018(3) dt.29-11-2018 2/2 fact some of the petitioners had informed to the informant that Md. Sami has been assaulted by some unknown person and he is lying injured.
Considering the fact that statement of the victim is not corroborated by medical evidence and allegation is general and omnibus, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of thirty days from the date of receipt of the order be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Sabour Police Station Case No.82 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioners.
