Learned counsel for the State is present and has filed counter affidavit.
The grievance of the petitioner in the writ petition is that the construction of official building is being made over a pond.
As per the averments made in the counter affidavit as well as the annexures appended thereto, the matter had come up before a Division Bench of this Court in C.W.J.C.No. 11460 of 2012 by way of Public Interest Litigation and the same was also dismissed on 24.06.2013. Further, it has been stated that the order
Patna High Court CWJC No.11319 of 2014 (2) dt.09-01-2017 2/2 was passed upon a report of the District and Sessions Judge, Jehanabad who had found that there was no water in the land in question. It has also been stated that the construction has already been made.
A copy of the counter affidavit was served on the learned counsel for the petitioner on 29.01.2015 and no rejoinder to the same has been filed.
In view of the aforesaid, the writ application stands dismissed.
