JUSTICE RAKESH KUMAR ORAL ORDER 29-01-2016 Heard Sri Gagan Deo Yadav, learned counsel for the petitioner and Sri Murlidhar, learned A.P.P. The sole petitioner, who is named in the F.I.R. as one of the main accused has prayed for grant of anticipatory bail in connection with Khirhar P.S. Case No. 12 of 2015 registered for the offence under section 147, 148, 149, 341, 323, 307, 386, 504, 506 of the Indian Penal Code .

Learned counsel for the petitioner submits that there is case and counter case. He further submits that F.I.R. has been lodged much belatedly and as such according to learned counsel for the petitioner it is a fit case for extending the privilege of anticipatory bail whereas on perusal of the F.I.R. the court is satisfied that in the F.I.R. itself specific accusation has been

Patna High Court Cr.Misc. No.47510 of 2015 (3) dt.29-01-2016 2/2 made against the petitioner. I do not find any ground to extend the privilege of anticipatory bail.

The petition stands dismissed.

If the petitioner surrenders and makes a prayer for regular bail within a period of six weeks from today, the learned court below may examine the same without being prejudiced with this order and pass appropriate order in accordance with law. (Rakesh Kumar, J) Praful/- U T
