This application for anticipatory bail arises out of Kadam Kuan P.S. Case No. 132 of 2018, disclosing the offence under Sections 341, 323, 379, 504, 506 of the Indian Penal Code.
Petitioner no. 1 and the informant are sisters. Petitioner no. 2 is the husband of petitioner no. 1. Petitioner no. 3 is son of petitioners no. 1 and 2.
Learned counsel for the petitioner appears to be correct in his submission that the dispute between the parties is
Patna High Court CR. MISC. No.41571 of 2019(3) dt.27-09-2019 2/2 over a residential house located at Patna. He has submitted that all the offences, except Section 379 of the IPC, are bailable and Sections 377, 379 has been added to add gravity to the case of the prosecution.
Considering the genesis of occurrence, this application is allowed. Let the petitioners, above-named, in the event of their arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each, to the satisfaction of the learned Sub-Judge-VII cum ACJM, Patna in Kadam Kuan P.S. Case No. 132 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the Police/ Court, as the case may be, as and when required and in the event of failure on their part to appear before the court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
