JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 31-08-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
Learned counsel for the petitioners is permitted to make necessary correction in paragraph No.15 of the petition. The petitioners apprehend their arrest in connection with Begusarai Town P.S. Case no. 266 of 2016, registered under Sections 304(B), 201, 120B/34 of the Indian Penal Code. The accusation is that the daughter of informant has been killed by her husband and other in-laws due to nonexecution of sale deed of two katha of land in the town of Begusarai and dead body of the deceased was disposed of without giving any information to the informant.
Patna High Court Cr.Misc. No.34211 of 2016 (3) dt.31-08-2016 2/2 Learned counsel for the petitioners submits that petitioners are mother-in-law and married sister-in-law (Nand), respectively of the deceased and they have falsely been implicated in this case. Further submission is that, in fact, deceased died due to illness in course of treatment and as she was suffering from disease earlier to the marriage. Further submission is that husband of the deceased in is custody. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in connection with Begusarai Town P.S. Case No. 266 of 2016, subject to the condition as laid down under Section 438
(2) of the Cr.P.C.
