The Petitioner seeks regular bail in connection with Bihia P.S.Case No. 95 of 2017, registered for offences punishable under Sections 304 (B)/34 of the Indian Penal Code. Allegation as per F.I.R. against the petitioner, who happens to be husband, is of killing the deceased due to demand of motorcycle and golden chain after six years of marriage. Submission of the learned counsel for the petitioner is that the petitioner has falsely been implicated in the case. It has also been submitted that due to differences with mother-in-law, deceased has committed suicide and it has come during investigation that petitioner and his family member were not
Patna High Court Cr.Misc. No.51829 of 2018 (4) dt.04-10-2018 2/2 present in the house at that time. It has also been submitted that other accused person has been granted bail by a Co-ordinate Bench of this Court vide order dated 05.02.2018, passed in Cr. Misc. No. 61377 of 2017 and the petitioner is in custody since 15.02.2018.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- ( Rupees Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- V, Bhojpur at Ara in connection with Bihia P.S.Case No. 95 of 2017, subject to the following conditions:- i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court. ii) The petitioner will not induce any witness or tamper with the evidence.
