2. The petitioner seeks bail in connection with Jokihat (Mahalgaon) P.S. Case No. 41 of 2009 registered for the offence under Sections 395 of the Indian Penal Code.

3. As per the prosecution case, the F.I.R. was registered against unknown for committing dacoity.

4. Learned counsel for the petitioner submits that the petitioner has not put on T.I. Parade, there is no recovery from the possession of the petitioner and he is in custody since 12.05.2023.

5. He further submits that the petitioner was earlier also accused in a case of dacoity in which he has been acquited.

6. Learned A.P.P. has vehemently opposed the

Patna High Court CR. MISC. No.44605 of 2023(2) dt.26-07-2023 2/2 prayer for bail.

7. Considering the aforesaid facts, this application for regular bail is allowed.

8. Let the petitioner, above named, be released on bail after completing 9 months in custody and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Araria/concerned Court below in connection with Jokihat (Mahalgaon) P.S. Case No. 41 of 2009.

9. The petitioner will mark his attendance at the Mahalgaon Police Station on first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
