The petitioner seeks bail in Kankarbagh P.S. Case No. 601 of 2016 instituted for the offences under Sections 324, 307, 504, 506 of the Indian Penal Code in which sections 302/34 were added later on.
The earlier bail application of the petitioner was rejected vide Annexure-1 to the present application taking into account that the petitioner is alleged to have poured petrol upon the deceased and set him on fire. As per the F.I.R., the petitioner is said to be the assailant.
A report was called for from the Trial Court. It has been reported that the trial is expected to be concluded within a
Patna High Court CR. MISC. No.4085 of 2021(3) dt.07-07-2021 2/2 period of nine months.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the nature of accusation and the stage of the case, I am not inclined to grant bail to the petitioner. The same is rejected. The Trial Court is directed to take all necessary steps to conclude the trial at the earliest preferably within a period of nine months from the date of receipt/production of a copy of this order.
