====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 15-09-2023 Heard Mr. Avinash Kumar, learned counsel appearing on behalf of the petitioner and Mr. Pranav Kumar, learned APP for the State.

2. Petitioner has filed the present application for modification of the order dated 05.05.2023 seeking extension of time for furnishing bail bonds in compliance of the terms and conditions as imposed vide order dated 05.05.2023 passed in Cr. Misc. No. 50381 of 2022.

3. Learned counsel appearing on behalf of the petitioner submits that despite repeated persuasion, the opposite party no.2 who is the legally wedded wife of the petitioner has

Patna High Court CR. MISC. No.48558 of 2023(2) dt.15-09-2023 2/2 refrained from filing the joint affidavit before the trial court in compliance of the order dated 05.05.2023 passed in Cr. Misc. No. 50381 of 2022 and due to the said reason, petitioner could not surrender before the court below to furnish bail bond and as such seeks extension of time for the said purpose.

4. Considering the aforesaid submission made on behalf of the petitioner, six weeks further time is granted to the petitioner to furnish bail bond in compliance of the terms and conditions as imposed vide order dated 05.05.2023 passed in Cr. Misc. No. 50381 of 2022.
