The petitioner has preferred this revision application against the judgment / order dated 17.05.2017 passed by the learned Additional District and Sessions Judge, 3rd, Bhagalpur in Criminal Appeal No. 72 of 2007 whereby confirming the judgment dated 17.05.2017 passed by the trial court in Trial No. 1428 of 2007 arising out of Sanhola P.S. Case No. 93 of 2005 under Sections 25(1-b) a & 26(1) of the Arms Act has modified the sentence to one year and nine months whereas the trial court had sentenced two years of simple imprisonment for committing each offence under Sections 25(1-b) a & 26(1) of the Arms Act and directed to run the sentence

Learned counsel for the petitioner in his argument does not challenge the conviction of the petitioner only submits for reducing the period of sentence for the reason that the occurrence took place 12 years back and no previous conviction of the petitioner has been proved by the prosecution so, it was his first offence. Having considered the aforesaid submission, the sentence of the petitioner is modified to one year and six months. With this modification in the sentence, this criminal revision application stands disposed of.
