====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-09-2024 Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 448, 341, 323, 307, 379, 504, 506/34 of the Indian Penal Code.
3. As per prosecution case, these petitioners are alleged to have assaulted informant and her son by means of lathi and iron rod. It is further alleged that accused persons snatched away gold chain and took other valuable items from the house of informant.
4. Learned counsel for the petitioners submits that both parties are co-villagers and due to petty dispute between
Patna High Court CR. MISC. No.46268 of 2024(3) dt.11-09-2024 2/2 children of both the parties, an altercation took place. As per F.I.R., all six named accused persons assaulted informant and these two petitioners assaulted the son of informant. Doctor has found the injury of the son of informant simple in nature.
5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the aforesaid facts and circumstances of the case and nature of injury allegedly caused by these petitioners, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Mohania, Kaimur at Bhabua in connection with Mohania P. S. Case No. 108 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
