The petitioner seeks regular bail in Bibhutipur P.S. Case No.225 of 2016 registered for the offence under Sections 363, 364, 302 and 201/34 of the I.P.C. Petitioner is not named in the F.I.R.. Latter on his name transpires on the basis of confessional statement of co-accused.

Submission of the learned counsel for the petitioner is that except confessional statement there is nothing against him. He is in custody since 7.10.2016 and he has been falsely implicated in this case by the police.

Patna High Court Cr.Misc. No.39531 of 2017 (3) dt.13-09-2017 2/2 Heard learned A.P.P. also who opposed the prayer on the ground of confessional statement of coaccused upon which dead body was recovered . Having heard both sides and in view of the facts and circumstances, as stated above, and nature of allegation, I am not inclined to grant bail to the petitioner. However, trial court is directed to expedite the trial. With this observation, this application is dismissed.
