JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-06-2019 Petitioner seeks bail in anticipation of his arrest in connection with Durgawati P.S. Case No. 123 of 2019 registered for the offences punishable under Sections 341, 323, 448, 307, 354B, 379, 420 and 406 of the Indian Penal Code. Allegation against the petitioner, who happens to be husband of the informant, is that he entered inside the house of the informant and assaulted her, causing injury. Further allegation is that petitioner got a sale deed executed by mother of the informant by playing fraud and also demanded 8 decimals of land and also sold the ornaments of the informant. Submission of learned counsel for the petitioner is that earlier also she has lodged a case against the petitioner under Section 12 of Domestic Violence Act being Complaint

Patna High Court CR. MISC. No.39491 of 2019(2) dt.27-06-2019 2/2 Case No. 472 of 2019 and she is in habit to file such type of false cases.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender before the court below within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabua, in connection with Durgawati P.S. Case No. 123 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
