The petitioners apprehend their arrest in Daudnagar P.S. Case No. 119/2016, registered for the offences punishable under Section 307 and other sections of the Indian Penal Code. The informant alleged that all the petitioners came to his house and began to assault with lathi and iron rod to the informant and his family members. His father got injuries on his face and other parts of body. Brother of the informant also got injuries. It is submitted that there is counter version being Daudnagar P.S. Case no. 118/2016 in which the informant and his father Arun Singh and family members are accused. Anugrah Narayan Singh petitioner no. 1 and Arun Singh are brothers. There

Patna High Court Cr.Misc. No.35401 of 2016 (4) dt.08-11-2016 2/2 is land dispute between the parties. Four injuries were found on the person of Arun Singh, out of which three injuries are found simple in nature. Fourth injury is bleeding through nose and the opinion is kept reserved, but the same is not sent as yet. Both the brothers have compromised the case.

Considering the facts aforesaid and the fact that there is mutual fight between the brothers on account of land dispute, the petitioners above-named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Daudnagar P.S. Case No. 119/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
