This is an application for bail in connection with Hajipur Sadar P.S. Case No. 174 of 2017 registered for the offences punishable under Sections 394, 411, 414 of the Indian Penal Code and 25(1-B)(a), 26 and 35 of the Arms Act.

Allegation against the petitioner as per FIR is that he has forcible taken pickup van and looted several articles and on chase the police has arrested him.

Submission of learned counsel for the petitioner is that as a matter of fact he has been implicated in the case at the instance of police and nothing has been recovered from his possession and he is in custody since 5.5.2017 having no criminal antecedent. Heard learned APP also.

Patna High Court Cr.Misc. No.42368 of 2017 (2) dt.12-09-2017 2/2 Having heard both sides and in view of facts and circumstances, I am not inclined to grant bail to the petitioner at this stage.

However, petitioner may renew his prayer for bail after framing of charge in this case.
