2. The petitioner apprehends his arrest in connection with Brahampur (Krishna Braham) P.S. Case No. 95 of 2023, registered for the offences punishable under Sections 498(A), 341, 323, 504, 506/34 of the Indian Penal Code along with Section 3/ 4 of the D.P. Act.
3. Learned counsel for the Opposite Party No. 2 submits that the case was referred for mediation and the issue in between the petitioner and the Opposite Party No. 2 stands resolved by way of one time settlement as the petitioner before the learned mediator became ready to pay

No.43187 of 2023(4) dt.22-02-2024 2/3 an amount of Rs. 2,50,000/- (Two Lakh Fifty Thousand) to the Opposite Party No. 2 and Rs. 50,000/- (Fifty Thousand) to be deposited in Sukanya scheme in favour of his child. Learned counsel for the petitioner does not dispute the said submissions made by the learned counsel for the Opposite Party No. 2 but then submits that the entire payment would be made on or before 08.04.2024. The learned counsel for the Opposite Party No. 2 next submits that in the event, if the entire amount as agreed is paid by the petitioner, in that event, the Opposite Party No. 2 shall withdraw the criminal case against the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner abovenamed, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on Provisional Anticipatory Bail on furnishing bail bonds of Rs. 2000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of the learned District and Sessions Judge, Buxar, where the case is pending/successor court in connection with Brahampur (Krishna Braham) P.S. Case No. 95 of 2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

5. It is made clear that in the event, if the petitioner does not pay the amount as agreed on or before 08.04.2024 and an application to that effect is filed by the Opposite Party No. 2 before the learned trial court after 08.04.2024 in that event, the learned trial court, shall forthwith cancel the Provisional Bail Bond of the petitioner but if no application on behalf of the Opposite Party No. 2 is filed alleging that one time settlement has not been paid by 18.04.2024, in that event, the learned trial court shall confirm the provisional bail bond on the same terms and conditions.
