ANJANA MISHRA ORAL ORDER 29-07-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner is apprehending his arrest in connection with C-III Case No. 29 of 2015 registered for the offence punishable under Section 47(a) of the Excise Act. It is submitted by learned counsel for the petitioner that the petitioner is an examinee and the allegation against the petitioner with regard to recovery of liquor under the Excise Act is wholly misconceived.
It is further submitted by the learned counsel for the petitioner that the village referred is also not the same village where the petitioner resides.
Considering the vague nature of allegation levelled
Patna High Court Cr.Misc. No.27854 of 2016 (2) dt.29-07-2016 2/2 against the petitioner, let the petitioner, in the event of his arrest/surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10000/- (ten thousand) with two sureties of the like amount to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with C-III Case No. 29 of 2015 subject to the conditions as laid down under Section 438
(2) Cr.P.C.
