The petitioner seeks bail in connection with Ramgarh P.S. Case No. 34 of 2024 instituted for the offence under Section 394 of the Indian Penal Code.

Prosecution case in brief is that while the informant and his friend, namely, Munna Paswan was going to his village, he was accosted with three unknown miscreants who have snatched their mobile phones.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 20-04-2024. Petitioner is a man of clean antecedent.

It has been further submitted by the petitioner's

Patna High Court CR. MISC. No.44763 of 2024(2) dt.27-06-2024 2/2 counsel that petitioner has been falsely implicated in the present case. Petitioner is not named in the FIR. Name of the petitioner has transpired during the course of investigation. It is submitted that two mobile phones, which is alleged to be stolen, were recovered from the house of the petitioner but the same belongs to the petitioner. It is next submitted that petitioner was not put on T.I. Parade.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, clean antecedent of the petitioner and nature of accusation, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Ramgarh P.S. Case No. 34 of 2024.
