The petitioner seeks regular bail in Special POCSO Case No.03 of 2017 arising out of Dagrua P.S.Case No.89/16 registered for the offence under Sections 363/366A of the I.P.C.
Earlier prayer for bail of the petitioner was rejected vide Annexure-1 with observation that the petitioner may renew his prayer for bail before the trial court after examination of the prosecutrix.
Submission of the learned counsel for the petitioner is that the prosecutrix has been examined and
Patna High Court Cr.Misc. No.43528 of 2017 (2) dt.13-09-2017 2/2 though she has supported the prosecution case but the same has been controverted under section 164 Cr.P.C. and so far only four witnesses have been examined in this case.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, at present I am not inclined to grant bail to the petitioner. However, as four witnesses have been examined, the trial court is directed to expedite the trial and conclude within a period of six months after conducting the trial day to day basis and regular basis.
With this observation this application is dismissed.
