Petitioners apprehend arrest in connection with Town P.S. Case No. 446 of 2019 registered for the offence punishable under sections 420, 384, 506, 509/34 of the Indian Penal Code and 67 of the Information Technology Act.
Learned counsel appearing for the petitioners submits that petitioners have been falsely implicated in this case. As a matter of fact, informant is legally wedded wife of petitioner no. 1 and they were living together happily, which

No.51762 of 2021(2) dt.13-04-2022 2/2 is evident from the Marriage Certificate contained in Annexure-2, but as it was inter case marriage which was not acceptable to her family, at the instance of their family members, the informant was brought back to her parental home. Petitioner no. 1 made all efforts to bring his wife back but her family members refused for the same. Petitioner filed Matrimonial (Restitution) Case No. 300 of 2016 which was decreed ex parte in favour of the petitioner no. 1, which is evident from the judgment contained in Anenxure-3. Petitioners have no criminal antecedent.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing personal bond to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Town P.S. Case No. 446 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C. (Arvind Srivastava, J) mcv/- U T
