2. Petitioner seeks regular bail in connection with Kazi Mohammadpur PS Case No. 200/2011 registered for the offence punishable under Sections 384/387 of the IPC.

3. The allegation, as per First Information Report, is that the informant received a call from mobile no. 9576256202 on his mobile no. 9031985912 and the caller demanded Rs. 2 Lacs as an extortion money and it is further alleged that again on 17.08.2011, a call was made from the same mobile demanding the amount in question.

4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and he has not committed any offence in the manner alleged. Learned counsel further submits that the FIR was lodged in the year 2011 and the petitioner was arrested on 19.08.2020 and thereafter, the chargesheet has been submitted by the police against the petitioner. Learned counsel also submits that the petitioner never demanded any extortion money from the informant and his mobile phone has been misused by his friend.

5. Learned counsel next submits that petitioner has got no criminal antecedents and he is not a person of criminal bent of mind inasmuch as since 2011, no further case has been filed against him.

Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner is in custody since 19.08.2020, chargesheet has been submitted in the matter and there is no likelihood that the petitioner will abscond and tamper with the evidences, if released on bail, I am inclined to grant regular bail to the petitioner.

7. Accordingly, let the petitioner, AMIT KUMAR @ AMIT KUMAR SINGH be released on bail on furnishing bail

No.2718 of 2021(3) dt.24-06-2021 3/3 bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st (East)-cum-Sub Judge, Muzaffarpur in connection with Kazi Mohammadpur PS Case No. 200/2011.

8. It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines social/physical distancing and sporting masks.
