Petitioner seeks bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

Four persons allegedly robbed to the informant, two were identified as Amit Kumar and Ram Sagar Kumar. Remaining two could not be identified.

Submission is that the impugned order reveals that the name of the petitioner surfaced in the confessional statement of co-accused-Prince Kumar who is not named in the FIR. Co-accused-Md.Piku @ Md. Pinku @ Md. Pikku has already been allowed bail by a Coordinate Bench of this Court on 17.02.2021 in Cr.Misc. No. 38998 of 2020. Petitioner is in custody since 22.01.2020.

No.38523 of 2020(2) dt.23-02-2021 2/2 Considering lack of sufficient material to refuse prayer for bail, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bihariganj Police Station Case No.22 of 2020 with following conditions:

(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
