JUSTICE RAKESH KUMAR ORAL ORDER 15-09-2017 Heard Sri Dhananjay Kumar No. 2 , learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner , who is in custody since 04.07.2017 in Adapur P.S. Case No. 142 of 2016 registered for the offence under section 414 /34 , 272/ 34, 273/ 34 of the Indian Penal Code 1860 and Section 47(a)/54 of the Bihar Excise Amendment Act , 2016 has prayed for grant of bail primarily on the ground that petitioner was made accused only on the basis of confessional statement of the co- accused and petitioner is having clean antecedent. This fact has been mentioned in paragraph no. 3 of the petition . Considering the fact that petitioner's name has come on confession, nature of accusation, clean antecedent as well as period of custody, let the petitioner Rajesh Yadav be enlarged
