2. The petitioner has preferred this application for grant of regular bail in connection with Buxar Rail P.S. Case No. 27 of 2024 dated 20.03.2024 registered for the offences punishable under sections 147, 148, 149, 341, 323, 307 and 353 of the Indian Penal Code and Section 141 and 147 of the Railways Act.
3. As per the prosecution case, when the informant was on duty at the railway station, he saw a person who stepped down from the train and started walking, the petitioner stopped the informant, he called 8-10 miscreants and they surrounded the informant and also started assaulting him. They threatened him to throw on railway track. It is further alleged that the
Patna High Court CR. MISC. No.46587 of 2024(2) dt.23-07-2024 2/2 occurrence was witnessed by his colleague, he was rescued and the petitioner was apprehended while others fled away.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. No specific allegation against the petitioner. The petitioner has antecedent of four criminal cases as stated in para 3 of the bail petition. The petitioner is in custody since 21.03.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Bhojpur at Ara in connection with Buxar Rail P.S. Case No. 27 of 2024.
7. The application stands allowed.
