JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 20-01-2016 Without going into the nitty-gritty of the dispute raised in the present writ application, based on the submissions made by the counsel for the petitioner on the limited issue, writ application is disposed of with a direction upon the enquiry officer as well as the disciplinary officer that the enquiry should now be completed within a reasonable time-frame.
It is hoped and expected that the petitioner renders assistance in the regular conduct of the enquiry for its conclusion. A final decision would be taken dependant upon the evidence and the outcome of the findings given by the enquiry officer.
Counsel for the petitioner submits that even though petitioner is under suspension, he is not getting any subsistence allowance. The authorities surely have a duty to examine as to why petitioner is not being extended the benefit of subsistence allowance during the period of
Patna High Court CWJC No.13270 of 2014 dt.20-01-2016 suspension. Decision in this regard must also be taken on priority basis. Writ application is disposed of with above observation and direction. (Ajay Kumar Tripathi, J) R.K.Pathak/- U
