JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-10-2015 Heard learned counsels for the petitioner and the State. The petitioners being the parents, brother and unmarried sister of the husband of the informant are apprehending arrest in a case registered for the offences punishable under Sections 341, 342, 323, 379, 354, 494, 498A and 504/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. The basic accusation is of torture for non-fulfillment of the dowry demand and performing second marriage by the husband of the informant.
It is submitted by learned counsel for the petitioner that the accusation against the petitioner is omnibus and general and thrust of accusation is against the husband of the informant who is
Patna High Court Cr.Misc. No.49461 of 2015 (2) dt.29-10-2015 2/2 in custody. Moreover, the husband of the informant is still ready to keep the informant as wife with full dignity and honour, statement to that effect has been made in para 11 of the petition which reads as follows:- "That the husband of the informant is ready to keep the informant with dignity."
Considering the thrust of accusation against the husband of the informant, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Munger in connection with Harpur P.S. Case No. 31 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
