JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-09-2017 Heard learned counsel for the petitioner and the State. Petitioner is in custody in connection with Habibpur (Bhagalpur) P.S. Case No. 25 of 2017 for an offence under sections 324, 307 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner and the informant are own brothers and there is land dispute between them.

In para-9 it has been stated that the instant case was filed after four months and six days delay. The petitioner is in custody since 15.5.2017.

Having regard to the fact that there is inordinate delay of four months and six days in lodging of FIR and also considering the fact that there is land dispute between the parties

Patna High Court Cr.Misc. No.43998 of 2017 (2) dt.19-09-2017 2/2 and the petitioner and the informant are own brothers, let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-XII, Bhagalpur, in connection with Habibpur (Bhagalpur) P.S.
