JUSTICE ASHUTOSH KUMAR ORAL ORDER 28-04-2022 This case has been taken up on priority as it was directed to be listed on 24.02.2022 by a co-ordinate Bench of this Court vide order dated 16.02.2022.

Heard the counsel for the parties.

The petitioner seeks bail in anticipation of her arrest in connection with Sangrampur P.S. Case No. 59 of 2021, dated 09.03.2021, instituted for the offences under Sections 467, 468, 420 and 34 of the Indian Penal Code.

Patna High Court CR. MISC. No.52113 of 2021(4) dt.28-04-2022 2/3 The accusation against the petitioner is of having obtained employment of Anganwari Sevika on fake and forged certificates.

It has been submitted on behalf of the petitioner that the accusation is absolutely false and based on surmises and conjectures. No opportunity was given to the petitioner to explain her bona fides.

Be that as it may, the counsel for the petitioner has submitted that once such an accusation was raised against her and others, she was not taken into employment and has not been paid a farthing ever since her appointment. Regard being had to the facts afore-stated, the petitioner, in the event of her arrest or surrender before the learned Court below within a period of four weeks, is directed to be released on bail on her furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Munger in connection with Sangrampur P.S. Case No. 59 of 2021, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

Patna High Court CR. MISC. No.52113 of 2021(4) dt.28-04-2022 3/3 It is, however, cautioned that the petitioner shall participate in the investigation and any attempt on her part to evade the investigative process, would render the bail granted to her liable to be cancelled.

The application stands allowed accordingly.
