JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 06-10-2016 Heard learned counsel for the petitioner, learned counsel for the Bank and learned A.P.P. for the State. The petitioner, who is the Officer in the Canara Bank, apprehends arrest in relation to Sasaram Town P.S. case No.523 of 2016 registered under Sections 306 and 120(B)/34 of the Indian Penal Code.

Informant alleges that his son committed suicide leaving his suicide note in which he has alleged that the petitioner being an Officer of the Canara Bank created liabilities against the petitioner's son and having in burden by the liabilities the son committed suicide.

Learned counsel for the petitioner submits that as a

Patna High Court Cr.Misc. No.31395 of 2016 (3) dt.06-10-2016 2/2 matter of fact Canara Bank has not loaned any money either to the informant's son or the informant's family. Upon query by the police, Canara Bank informed the police accordingly. Be that as it may, the petitioner above named, in the event of arrest or surrender in the court below within five weeks from the date of receipt/production of a copy of this order, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas, Sasaram in connection with Sasaram Town P.S. case No.523 of 2016 (G.R. No.1107 of 2016), subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
