JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 10-11-2015 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case under Sections 323, 504, 354B, 307 and 379/34 of Indian Penal Code. Learned counsel for the petitioner submits that no case under Section 307 of the I.P.C. would be made out, as the injury is simple in nature. He further submits that the allegation under Section 354 B and that of theft are exaggerations. In my view, if the petitioner surrenders before the court below (Chief Judicial Magistrate, Katihar) and prays for regular bail, which would be disposed of preferably on the same day without being prejudiced by this order.

With the aforesaid observation, this application stands disposed of.
