ANJANA MISHRA ORAL ORDER 23-12-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner apprehends his arrest in connection with Bhabhua P.S. Case No. 622 of 2015 for the offences registered under Sections 420, 419 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the present first information report has been filed without any due enquiry or explanation having been called for from the petitioner and the allegation against him is that he has passed the examination and obtained appointment after taking the help of some scholars, which is wholly misconceived. It is further submitted that at no point of time, any such allegation has been revealed against him at the time of passing of examination and, yet without making necessary enquiries the present allegation has been levelled against the petitioner.

No.32498 of 2016 (2) dt.23-12-2016 suspended and he is facing departmental proceeding in which he is duly cooperating, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhabhua in connection with Bhabhua Town P.S. Case No. 622 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
