The petitioner being the Principal of the school has been hauled up under sections 409 and 420 IPC vide Khijarsarai P.S. Case No.136 of 2016.
for construction of the school building a sum of Rs. 12 lakh and odd was sanctioned to the petitioner under Sarva Siksha Ahiyan. The Block Education Officer(informant) has alleged that the work worth Rs. Six lakh and odd was only completed.
Learned counsel submits that the petitioner is ready and willing to complete the remaining work as per the specification if granted the privilege of bail. He would also be willing to deposit certain amount as directed by this Court for obtaining
Patna High Court Cr.Misc. No.47394 of 2017(2) dt.16-10-2017 2/2 the privilege of bail. The petitioner is in custody since 26.07.2017.
Having regard to the stand taken by the petitioner and considering the other relevant facts reflecting from the records, prayer for bail is allowed. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned ACJM, VIIth, Gaya in Khijarsarai P.S. Case No. 136 of 2016. Along with the bail bonds, the petitioner shall produce receipt/document showing deposit of a sum of Rs. 3.5 lakh in the office of the informant or in appropriate head of the government. Such deposit shall be without prejudice to his right and contention.
