ANJANA MISHRA ORAL ORDER 05-10-2015 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Aurai P.S. Case No.36 of 2010 for allegedly having committed the offence under Sections 304B, 328 and 201/34 of the Indian Penal Code, which is pending in the court of the learned Chief Judicial Magistrate, Muzaffarpur. The petitioner is the husband of the deceased Aradhana Kumari, who died in her matrimonial home. The marriage in question had been solemnized on 28.5.2009 and the date of occurrence is 14.4.2010 and, therefore, even before the lapse of one year, the girl died in her matrimonial home. No.29115 of 2015 (3) dt.05-10-2015 2/2 committed suicide as she developed some illicit relation with a co-villager and due to the said relation, she became pregnant and for the said reason she is said to have remained very nervous. Learned counsel further submits that there is no material in the case diary to substantiate that it is not a case of suicide. However, considering the fact that the petitioner is the husband and it is his moral duty to maintain the well-being of his wife, I am not inclined to grant anticipatory bail to the petitioner. It is, accordingly, rejected.
