16-01-2015 Heard learned counsel for the petitioner and Sri Nishi Nath Ojha, learned counsel, who has appeared on behalf of Central Bank of India.

The present petition has been filed for initiating contempt proceeding against Opp.Parties on an allegation of wilful disobedience to an interim order dated 20.08.2013 passed in C.W.J.C.No.8273 of 2013. The order dated 20.08.2013 is quoted herein below:

"Learned counsel for the respondents prays for

Patna High Court MJC No.159 of 2014 (2) dt.16-01-2015 2/2 and is granted four weeks time to seek instruction and file counter affidavit in the case.

Put up after four weeks.

Any deduction from the deposit of the petitioner shall be subject to result of this case." Sri N.N. Ojha, learned counsel for the Central Bank of India submits that main writ petition is still pending and, moreover, on perusal of the order dated 20.08.2013, no contempt is made out.

Keeping in view the fact that main writ petition is still pending, there is no reason to pass any positive order in the present case.

The petition stands dismissed.
