The petitioner apprehends his arrest in a case under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act. The informant alleged that he was going along with his brother-in-law but the petitioner along with other accused persons made indiscriminate firing causing death of his brother-inlaw. It is submitted that the informant is not an eye-witness of the occurrence. The police got information from other sources. Be that as it may, in view of the direct allegation made against the petitioner and the fact that the petitioner along with Manoj Kumar fired causing death of the deceased on the
Patna High Court Cr.Misc. No.40705 of 2015 (2) dt.05-10-2015 2/2 spot, I am not inclined to enlarge the petitioner on anticipatory bail in Samastipur (Muffasil) P.S. Case No. 62 of 2015. Accordingly, the same is rejected.
