ANJANA MISHRA ORAL ORDER 05-10-2015 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Sadar (Hajipur) P.S. Case No.195 of 2015 for allegedly having committed the offence under Sections 379 and 411 of the Indian Penal Code.
Case diary in the present case was called for, which has since been received.
Learned counsel for the petitioner submits that the petitioner is mainly the Driver of the truck in question, which had been hired by some persons and under instruction from the owner of the truck, he was sent to pick up plastic pipes.Learned counsel for the petitioner further submits that save and except
Patna High Court Cr.Misc. No.29141 of 2015 (3) dt.05-10-2015 2/2 the said position, the petitioner has no role to play though it has been stated that he was pilfering plastic pipes from the place of occurrence.
Considering the entire facts and circumstances and the materials in the case diary, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Sadar (Hajipur) P.S. Case No.195 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
