Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 22.11.2018 passed in Cr. Misc. No.65481 of 2018 and the allegation against the petitioner is of kidnapping of the minor daughter of the informant and committing rape.

Submission of the learned counsel for the petitioner is that the petitioner is in custody for grant of one year and two witnesses have been examined including the informant and further submission is that the other co-accused persons have been granted bail by a Co-ordinate Bench of this Court, vide order dated 17.4.2019 passed in Cr. Misc. 11602 of 2019.

Patna High Court CR. MISC. No.39092 of 2019(2) dt.27-06-2019 2/2 Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, since the trial is in progress, the learned trial court is directed to expedite the trial and conclude it as soon as possible.

At the same time, the Sr. S.P., Patna is also directed to ensure presence of the witnesses in the court below so that the trial may be concluded.

With the above direction, this application is dismissed.
