Mr Syed Ehteshamuddin, APP ====================================================== CORAM: HONOURABLE MR JUSTICE MADHURESH PRASAD ORAL ORDER 27-04-2022 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing for the State of Bihar. The petitioner seeks bail in Pandarak Police Station Case No 6 of 2020 instituted for the offence punishable under Section 395 of Indian Penal Code (for brevity, IPC) but charge sheet has been submitted under Sections 395, 412, 413 of IPC. Prayer for bail was earlier rejected by this Court under order dated 04.01.2021 passed in Cr Misc No 30401 of 2020 granting liberty to the petitioner to renew his prayer after framing of charges.

Learned counsel for the petitioner fairly submits that till date, charges have not been framed and there is no substantial progress in the trial.

No.53180 of 2021(12) dt.27-04-2022 2/2 Having consider the said submission, it is observed that this Court would not pass any order having the effect of reviewing the order passed in Cr Misc No 30401 of 2020. Prayer for bail is again rejected in view of the aforesaid observations.

Learned counsel for the petitioner is expected to honour his undertaking given in the instant proceedings today for depositing requisite Court fee and removing the defect (s), as pointed out, when called upon to do so.
