The petitioner apprehends his arrest in connection with Paras Bigha P.S. Case No.55 of 2015 registered under Sections 304B, 201 and 120B of the Indian Penal Code, pending in the court of the Judicial Magistrate, First Class, Jehanabad. The accusation is that all the accused persons including the petitioner, who happens to be the Bhaisur (elder brother-inlaw) of the deceased, killed the deceased for non fulfillment of the dowry demand.
Learned counsel appearing on behalf of the petitioner submits that the petitioner has played no role to kill the deceased
Patna High Court Cr.Misc. No.50671 of 2015 (3) dt.07-12-2015 2/2 and has falsely been implicated in this case. On the other hand, learned A.P.P. for the State submits that admittedly, the deceased died within seven years of her marriage.
Having considered the facts and the circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected. However, the petitioner is directed to surrender before the trial court within four weeks from today and pray for regular bail, which shall be considered by the trial court on its own merit without being prejudiced by the order of this Court.
