JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-08-2017 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with Sachivalaya P.S. Case No. 74 of 2017 for the offence under Sections 356 and 379 of the Indian Penal Code. The F.I.R. was lodged against unknown.

The petitioner in para 3 of the petition stated that he has no criminal antecedent.

The submission of the petitioner is that the alleged stolen mobile was purchased by him and the other offence i.e. Section 356 of the Indian Penal Code is bailable one. The petitioner has remained in custody for nearly two months. Considering the fact that the petitioner has no criminal antecedent as per statement on affidavit, let the petitioner,

Patna High Court Cr.Misc. No.35799 of 2017 (2) dt.10-08-2017 2/2 above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Patna in connection with Sachivalaya P.S. Case No. 74 of 2017, subject to the condition that the petitioner will extend full cooperation in conclusion of the trial and will not, in any manner, tamper with the evidence and influence the witnesses.
