The petitioner apprehends his arrest in Nathnagar (Lalmatia) P.S. case No. 152/ 2016 under Section 307 and other Sections of the Indian Penal Code.
The informant alleged that Mantu Mahto and Mohan Mahto, the petitioner, assaulted him with iron rod and Lathi respectively and broken his head. The informant alleged that his house was forcibly locked as the accused persons did not want that the informant should live in his house.
The learned counsel for the petitioner submits that petitioner is co-sharer of the informant. Some scuffle took place on account of land dispute. Injuries found on the informant are simple in nature.

No.35599 of 2016 (3) dt.27-09-2016 2/2 Considering the fact that petitioner happens to be agnate of the informant, there is land dispute and injuries found on the person of informant are simple in nature, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Bhagalpur in Nathnagar (Lalmatia) P.S. Case No. 152 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
